SKILLS WEST EXPO | TERMS & CONDITIONS
Any reference to ‘EOC’ refers to EOC Group PL (ABN 31 125 319 486) and any reference to SWX or ‘the event’ refers
to ‘Skills West Expo’, an event owned and managed by EOC.
Any reference to ‘the Client’ refers to the purchaser of Skills West Expo products and is the entity of which the signatory to these terms and conditions is authorised to represent.
1.0 GENERAL
1.1 Privacy
1.1.1 The client agrees to be bound by the National Privacy Principles (NPP’s), laws, binding schemes and/or contracts that uphold privacy principles that are substantially similar to the NPP’s in all its dealings with EOC.
1.1.2 The client consents to the use by EOC and its subsidiaries of the clients’ details and acknowledges that EOC and its subsidiaries may, at its discretion, forward such details and advertising leads to appropriate media partners/ suppliers for follow up on expo-related products.
1.2 Website Content
Clients warrant that all information they provide for websites publication is accurate, does not breach any law in Australia or the rights of any person. Users must not impersonate any person or entity or falsely state or otherwise misrepresent their affiliation with any person or entity.
1.3 Payment/Cancellations
1.3.1 Prices that have been set by EOC may vary at any time and without notice.
1.3.2 All amounts owing to EOC must be paid according to terms and dates on supplied Tax Invoices or services may be discontinued or charged at increased prices.
1.3.3 All prices listed on EOC websites or any other marketing materials will stipulate either inclusive or exclusive of GST.
1.3.4 Specific payment conditions may apply to the range of products and services; please refer to specific terms under those listed products/services for further clarification.
2.0 SKILLS WEST EXPO
2.0.1 Brand Use
In authorising to participate in Skills West Expo, the participating company agrees to permit usage of their corporate brand name and/or logo in any advertising or promotional material for the event. Specifically the aforementioned includes: broadcast, narrowcast, electronic, multimedia, print, direct mail, event photography, outdoor signage or any other medium that EOC may utilise.
2.0.2 Standard Booth
All standard booth packages come with the following provisions: basic stand shell construction, carpet, fascia signage, spotlights and a power outlet. Details can be obtained by contacting EOC. Additional lighting, power or any variation in the above will incur additional charges to the exhibitor. EOC reserves the right to change the standard booth provisions subject to supply.
2.0.3 Open Stand
All open stand packages come with the following provisions: carpet and a power outlet. Details can be obtained by contacting EOC. Additional lighting, power or any variation in the above will incur additional charges to the exhibitor. EOC reserves the right to change the open stand provisions subject to supply.
2.0.4 Space-Only
All space-only packages do not include any stand construction, fascia signage, lighting, power or carpet. These additions are optional incurring additional charges to the exhibitor. All additions must be confirmed with the EOC appointed or ‘client nominated’ stand builders for that respective show prior to the event commencing. Details can be obtained by contacting EOC.
2.0.5 Event Venue, Vendors & Suppliers
EOC will provide a selection of appointed event vendors to assist exhibitors in event construction, AV, furniture, lighting, power, transport and venue facilities. It is the responsibility of the exhibitor to organize directly with the event vendor any additional requests outside of basic 2.0.2 2.0.3 and 2.0.4 supply. All exhibitor requests from the event vendors are the sole responsibility of the exhibitor.
2.0.6 Event Date Change or Cancellation
EOC reserves the right to alter the date and venue location of the event at anytime and where due to unforeseen circumstances an event is cancelled and/or postponed, EOC reserve the right to publish a new event date and venue location within thirty (30) days of the notification of cancellation and/or postponement to exhibitors.
If no new date is published, then EOC will return all monies received prior to 31st December of the current year. Exhibitors warrant to EOC that where a change in an event date is made and a new event date published within the terms stated above, where an exhibitor is unable to attend the new event date, the 2.1 Payment/Cancellation terms will apply.
2.0.7 Tag & Testing
To ensure your participation in the event meets the appropriate OH&S worksafe guidelines for electrical equipment on site. All electrical devices and leads brought by you into the event must be tagged and tested. The event will have onsite, a tag and test team and any items requiring tagging and testing will be at the cost to the exhibitor.
2.0.8 Floorplan Location
An exhibitor’s floorplan location at SWX cannot be secured or guaranteed until confirmed by the National Event Manager. Approximately two (2) months prior to the event, EOC will create a draft floorplan for exhibitors to review and yet EOC reserve the right to amend a client’s location, the venue, and the final floorplan of the event at anytime.
2.0.9 Seminars
Where SWX provides seminars rooms or schedules for exhibitors, EOC reserve the right to alter the location of the seminar within the event, alter the schedule of the seminar or withdraw the seminar provision if it is warranted.
Exhibitors participating within an EOC seminar room will be notified within 7 days of the event date, if any of the above changes are made. The basic provision of an EOC seminar room is: Linear walling, minimum 25 seats, table, projector and screen. Any changes or requests to the basic EOC seminar provision will be at the
cost to the exhibitor.
Where an exhibitor acquires a seminar room for its ‘exclusive use’ as part of an exhibitor contract at SWX, unless prearranged all costs associated are the responsibility of the exhibitor. The exhibitor must manage the ‘exclusive use’ seminar schedule and provide the schedule to EOC for publication 14 days prior to the event where applicable.
2.0.10 Exhibitor Stand, Visual Display, Brochure/banner ware or Content
EOC reserve the right to reject or remove any web, visual, written or printed material on display or distributed from an exhibitors stand where such material may be deemed illegal under state or federal government laws, be offensive, anti-competitive or conflictive with other exhibitors or contracted sponsors or partners of The National Careers and Employment Expo or any other product or service developed or produced by EOC.
2.1 Payment/Cancellations
i) Cancellation for any event must be received in writing by EOC.
ii) Cancellation received at anytime outside of ninety (90) days prior to the event date will attract a penalty equal to thirty percent (30%) of the total order. Balance refundable within 60 days after the event/s date.
iii) Cancellation received ninety (90) days prior to the event date will attract a penalty equal to thirty percent (30%) of the total amount paid/and or owing by the client in respect of the event. Balance carried over to an alternative 2010 event or 2011 events.
iv) Cancellation received sixty (60) days prior to the event date will attract a penalty equal to sixty percent (60%) of the total amount paid/and or owing by the client in respect of the event. Balance carried over to an alternative 2010 event or 2011 events.
v) No cancellation can be received within thirty (30) days prior to the event date and 100% of monies owed/paid will be sought/retained by EOC.
vi) The client shall not be permitted to exhibit at the event unless accounts in respect of the event are finalised at least thirty (30) business days prior to the event date. Non-attendance including non-cancellation for an event results in 100% forfeit of monies paid/owed and balance will be sought/retained by EOC.
2.2 EOC Websites (including skillswestexpo.com.au)
It is the responsibility of the client to ensure that the submitted advertising complies with all federal, state and territory legislation and any other anti-discrimination legislation of the State in which they do business.
This will include but is not limited to:
a) The Trades Practices Act, Fair Trading Acts (State) and equivalent legislation
b) State and Commonwealth anti-discrimination legislation
c) Any copyright, trade mark or obligation of confidentiality
d) Any law of defamation or obscenity
e) The Privacy Act (1998)
EOC reserves the right to either reject or remove any advertisement from its site(s) for any breach of, but not limited to, the above. The following job advertisements are prohibited and users agree not to use the website for any of the following:
a) Pyramid, franchise, club membership or multi-level marketing or any other arrangement or business opportunity that requires an upfront payment or pays commission only.
b) Jobs that do not provide full details of the product or service involved in the position
c) Jobs that require promotion of gambling or gambling websites
d) Jobs that involve activities, products or services that may be considered offensive or illegal.
2.3 Print Advertising
The word ‘advertisement’ will be placed above any advertisement, which in the publisher’s opinion resembles advertorial material. The sponsor of every advertisement must be identified by product or company. The Publisher reserves the right to reject any advertisement as a whole. All advertisements are accepted subject to Publisher’s approval, without prejudice, in every aspect with regard to material, layout or otherwise and may be modified or altered at the Publisher’s discretion if the material supplied is not in accordance with the mechanical specification. The cost to the Publisher of making good any such material shall be paid by the client to the Publisher on demand.
2.3.1 Indemnity
The Publisher shall not be responsible for any loss or damage consequent to the failure of an advertisement to appear in accordance with the instruction given by the client. The client represents and warrants to the Publisher that no advertisements placed will be misleading, deceptive, defamatory, libellous, or false in any particular, or in contradiction of any law or statute. The client shall indemnify and keep the Publisher indemnified against any claims, costs, damages or liabilities whatsoever arising from any breach of this representation and warranty.
EOC and all of their officers hereby disclaim any liability, however arising, for any negligence and any consequence whatsoever of any such negligence. The Publisher reserves the right to place advertisements in any position except where specifically instructed by the client and agreed upon by the Publisher in writing.
2.3.2 Payment/Cancellations
i) Cancellations must be received in writing at least thirty (30) days prior to the material/copy deadline.
ii) No cancellation can be received within thirty (30) days prior to the material/copy deadline and 100% of monies owed/paid will be sought/retained by EOC.
iii) Cancellations will not be accepted for bookings made after the booking deadline. Advertising material must be collected by the client immediately after use. The Publisher shall not be held responsible for material not collected by the client within fourteen (14) days of the appearance of the last scheduled advertisement.
iv) Payment terms are as noted on the order form.
2.4. Indemnity
i) EOC will not be liable for any damages in the event that any EOC website is temporarily unavailable to users (by interruption, suspension or termination) for any reason, including but not limited to computer or communication link downtime attributable to malfunction, upgrades or preventative or remedial maintenance activities.
ii) The client indemnifies EOC and its officers against all claims, actions, suits, liabilities, costs and expenses incurred on any account by EOC as a result of the listing or intended listing of any advertisement by that advertiser on an EOC Website, or any related site.
iii) EOC cannot and does not guarantee or warrant that any file available for downloading or delivered via email through the site will be free from infection or viruses, worms, Trojan horses or other destructive and contaminating code.
iv) EOC will be under no liability to users and/or recruiters in respect of any loss or damage (including consequential loss or damage) which may be incurred or which may arise directly or indirectly in respect of services supplied by EOC.
v) EOC accepts no responsibility for the content of any job notices as they appear on this site. Candidates acknowledge that EOC has no control over the quality, safety or standard of positions advertised or the truth or accuracy of the information contained in the job notices.
vi) Candidates acknowledge that any use of information recruiters gain from job notices appearing on this site will be at the candidates’ own risk as EOC accepts no liability for the accuracy or reliability of information contained within these notices, unless contracted.
